Important information you need to know:
DOCUMENTS After you have made the decisions and paid the funeral cost it is important to tell your family. Share with them what you have done. Give a trusted member of your family a complete copy of all documents concerning your arrangements and the prepaid funeral contract.
DEPOSIT OF MONEY The funeral provider is required to deposit the money you paid into an ESCROW account for your benefit. This money will remain in the escrow account until the time of your death or a request to cancel the contract. The ESCROW account for your funeral is at JPMorgan Chase Bank.
RECEIPT You will receive a receipt document from the plan administ rator, Abbit Management Corp and the escrow agent JPMorgan, listing all the information concerning your account .
TAXES If your account requires the payment of taxes on the income earned, you will receive a 1099-INT for your record. If you do not file income tax, you do not have to file the report. In most cases the resulting amount of tax is very small or non applicable.
GUARANTEED OR NONGUARANTEED CONTRACTS Your contract may be either a " guaranteed price agreement" or a "non-guaranteed price agreement". Each contract has unique conditions. If your contract is a "guaranteed price agreement" and the choices of services and merchandise are paid in full and not changed, no additional money will be required for those items which are prepaid. If your contract is a "non-guaranteed price agreement", your family will be responsible for any difference between the current charges at the time of the funeral and the amount in the ESCROW account. CANCELLATION Life is uncertain and changes do take place. In some cases, before death occurs, the contract may need to be cancelled and by law, you are entitled to receive a minimum 90% refund of both your original payment and all earned income in your ESCROW account. It is important to note that contracts certified "irrevocable" by the Department of Human Services cannot be cancelled for any reason. Upon request the funeral provider will normally transfer the "irrevocable" contract to another funeral provider. By law a contract may not be cancelled following death except under certain circumstances.
WHEN DEATH OCCURS Due to the fact that you have pre-arranged and pre-paid your funeral, upon your death, your family should call the funeral provider where you established your ESCROW account. This must be done even if death occurs away from your local area.
TRANSFERABLE Your pre-paid account has been established for your benefit and can be transferred to any other funeral provider of your choice at anytime.
IT'S THE LAW These standards and requirements are established by the Prepaid Funeral and Cemetery Sales Act 255 of 1986 as amended.
